Finally, transparent procurement laws ensure credibility, attracting serious investors while protecting public interest.
African examples illustrate how these tools translate into outcomes. In Kenya, a dedicated PPP framework has helped advance major road concessions. South Africa’s Renewable Energy IPP Procurement Programme has shown how transparent bidding processes can mobilize billions in investment and diversify the energy sector. In Senegal, the Dakar Toll Road PPP has reduced travel times dramatically while ensuring private partners see value in their investment. These stories show that when legal frameworks are sound, PPPs thrive.
The lesson is simple: policies can inspire, but only strong legal tools can transform them into real projects. A policy without the legal scaffolding to support it often remains a political promise rather than a tangible outcome. Legal frameworks provide the certainty that translates aspirations into enforceable commitments, setting out how risks are shared, how disputes are resolved, and how accountability is maintained. PPPs are therefore not just about sharing risks and rewards; they are about building trust, trust that the rules are clear, contracts will be respected, and commitments will be enforced.
